Exclusive: General (retd) Faiz Hameed likely to be sentenced within two weeks

The military court-martial proceedings against Lt. Gen. (R) Faiz Hameed, the former ISI chief and alleged mastermind behind the May 9, 2023 attacks on military installations, are nearing conclusion. Sources indicate that he is likely to receive a verdict within the next two weeks, potentially facing a severe punishment.

Lawyer’s statement on the trial

Barrister Mian Ali Ashfaq, representing Faiz Hameed along with two colleagues, confirmed to senior journalist Ansar Abbasi that the trial is expected to wrap up soon. When questioned about the possibility of Faiz becoming a state witness against his former ally, Imran Khan, Ashfaq declined to confirm, citing the Official Secrets Act under which the proceedings are being conducted. While he refrained from commenting on the speculation of a death sentence, he noted that the trial commenced after the filing of a charge sheet and will conclude shortly.

Key allegations against Faiz Hameed

According to the ISPR, Faiz Hameed faces multiple charges, including:

  1. Planning the May 9 attacks: He is accused of orchestrating a conspiracy that led to widespread unrest and targeted military facilities across the country.

  2. Political interference: Violations of the Official Secrets Act and active involvement in political activities.

  3. Misuse of authority: Improper use of official resources and involvement in unauthorised operations.

  4. Compromising state security: His actions allegedly jeopardised national interests and state security.

Context of arrest

Faiz Hameed was initially detained in connection with the Top City housing society scandal, but subsequent investigations uncovered his involvement in several high-profile crimes. This includes his alleged role as the mastermind behind the May 9 attacks, described as an act of sedition. More than 200 military officers are reportedly under scrutiny for their connection to this conspiracy.

Background of May 9 Events

The unrest erupted two days after Imran Khan’s arrest, with the former prime minister warning beforehand of nationwide protests if detained. Faiz Hameed is alleged to have been the chief planner of these events, a claim that strengthens the case for Imran Khan’s own trial on similar charges.

Legal Proceedings and anticipated punishment

Constitutional experts believe Faiz Hameed is almost certain to receive a harsh sentence, with the likelihood of either death penalty or life imprisonment. The field general court-martial proceedings, initiated on August 12, 2024, have been conducted under the Pakistan Army Act.

Additional charges and complaints

During the investigation, Faiz Hameed was implicated in various scandals, including:

  1. Land Grabbing Allegations: Top City’s owner, Moiz Ahmed Khan, accused Faiz and his brother, Sardar Najaf Hameed (a patwari), of pressuring him to transfer property.

  2. Illegal Raids and Extortion: Moiz claimed that under Faiz’s orders, ISI officers forced him to pay PKR 40 million in cash.

Broader Implications

Faiz Hameed’s downfall highlights the military’s crackdown on high-profile figures involved in subversive activities. The ISPR has confirmed multiple concurrent court-martial proceedings against him, with charges ranging from treason to violations of state interests.

A turning point for accountability

This trial signifies an important moment in Pakistan’s judiciary-military dynamics, as it addresses the role of a senior figure accused of undermining state security. Faiz Hameed’s conviction could also pave the way for further investigations and trials against other key individuals, including former Prime Minister Imran Khan.
