ISLAMABAD: The Chief Justice of Pakistan (CJP) Qazi Faez Isa knocks down in a befitting reply to Justice Ijazul Ahsan in his letter dated 18th November 2023.

CJP Isa has responded to the concerns raised by Justice Ijaz ul Ahsan regarding the workings of the committee constituted under the Supreme Court (Practice and Procedure) Act, 2023.

Expressing disappointment in the communication received on 17th November 2023, Chief Justice Isa addresses the alleged lack of consultation on the constitution of Benches. The Chief Justice clarifies that his door is always open for discussion, and he is available through intercom and cell phone. He notes that despite this, there was no attempt by Justice Ahsan to communicate concerns directly.

Chief Justice Isa details the efforts made to reach Justice Ahsan, including a call on the intercom that went unanswered. The Chief Justice further mentions that, based on Justice Ahsan’s request, the Committee meetings were rescheduled to Thursdays. However, Chief Justice Isa now questions the wisdom of this decision.

The letter underscores the primary responsibility of a judge to attend to judicial work. The Chief Justice highlights that, contrary to allegations, the Committee’s decisions were minuted and uploaded to the Supreme Court website, demonstrating transparency.

In response to Justice Ahsan’s accusations, Chief Justice Isa reminds him of the first order signed on 18th September 2023, where consultation was promised on the constitution of Benches. He emphasizes that he has consistently followed through with the decisions made in Committee meetings.

Chief Justice Isa clarifies that the delay in the Committee’s first meeting was due to Justice Ahsan’s non-availability and cites subsequent delays based on conferences and public holidays. He states his unwavering availability and accommodation of colleagues.

The letter ends with an invitation for Justice Ahsan to propose suggestions for Bench reconstitution, with a commitment to convene a Committee meeting for discussion.
