ISLAMABAD: In a bold stance, Pakistan categorically rejects the recent judgment handed down by the Indian Supreme Court concerning the status of Indian Illegally Occupied Jammu and Kashmir (IIOJK). The decision, deemed by Pakistan as an illegitimate move, stands in stark defiance of the UN Security Council Resolutions and undermines the longstanding international recognition of Jammu and Kashmir as a disputed territory.

The dispute, lingering on the UN Security Council’s agenda for over seven decades, is rooted in the aspirations of the Kashmiri people. Pakistan asserts that India lacks the authority to unilaterally dictate the fate of this contested region against the will of the Kashmiri people and international resolutions. Moreover, Pakistan refuses to recognize the supremacy of the Indian Constitution over Jammu and Kashmir, emphasizing that any process subservient to Indian constitutional authority holds no legal weight.

Pakistan condemns India’s attempts to sidestep its international obligations using domestic legislations and judicial verdicts. The plans to annex IIOJK, according to Pakistan, are destined to fail. The recent judicial endorsement of India’s actions in 2019 is criticized as a miscarriage of justice based on distorted historical and legal arguments.

The verdict, as per Pakistan’s perspective, fails to acknowledge the internationally-recognized disputed nature of the Jammu and Kashmir issue. It neglects the legitimate aspirations of the Kashmiri people, who have consistently rejected India’s unilateral actions. Pakistan contends that the judgment reflects a compromised judiciary under India’s ruling dispensation.

The restoration of statehood or similar measures cannot serve as substitutes for granting the right to self-determination to the Kashmiri people, insists Pakistan. The international community is urged not to be distracted from the gross human rights violations in IIOJK, perpetrated by India since August 5, 2019. Pakistan stresses that India’s measures aim to alter the demographic and political landscape in violation of international law and UN Security Council Resolutions.

Despite the verdict, Pakistan remains steadfast in providing political, diplomatic, and moral support to the people of IIOJK, advocating for their inalienable right to self-determination. The call for rescinding India’s measures echoes as a necessary step towards establishing an environment conducive to peace and dialogue in the region.
